Two months after being charged with drunken driving in an accident that killed her boyfriend, Kathryn Ryster was arrested again for DUI.
The 29-year-old Moline woman lost control of her vehicle on a rain-soaked Interstate 280 in Rock Island County on March 9. Her 1990 BMW crossed the median and collided head-on with a semitrailer.
Three days after the crash, her passenger and boyfriend, Brandon Rutledge, died in a Peoria, Ill., hospital from the head injuries he suffered in the wreck.
"I remember everything," Ryster said. "It was raining so bad they couldn't airlift him to Peoria. It is just terrible what happened.
"He was the love of my life. We were together seven years. We were about to get married."
When asked about the drunken driving allegations, Ryster said she was done talking.
Her problems with traffic offenses date back to her first charge of driving while unlicensed - at the age of 14. She has been convicted or pleaded guilty to driving without a valid driver's license or driving with a suspended license 18 times.
She was arrested again on drunken driving and speeding charges in Rock Island on May 13 - nearly two months to the day after Rutledge died.
Rock Island County State's Attorney Jeff Terronez said the DUI charge that resulted from the fatal accident was dismissed last month, but he said the dismissal was part of a legal strategy. Prosecutors and investigators may make a case for an aggravated DUI, he said, because of Rutledge's death.
Investigators still are collecting evidence, however, including the blood-alcohol content readings that were taken at Trinity Medical Center's West Campus immediately following the crash.
"We're likely to reinstate the charge," Terronez said of the DUI. "It's not that this one's over. From a procedural standpoint, it's the action we had to take. It does not preclude us from proceeding with charges."
William Bradley, of Joy, Ill., was the driver of the semitrailer that collided with Ryster's car, and he said Thursday that he would like to talk about the wreck but said he also is taking legal action against her. He said he already was aware that she has since been arrested for another DUI.
A traffic crash report from the Illinois State Police indicates that Ryster told troopers Rutledge had grabbed the steering wheel, suggesting he may have caused the accident. When asked Wednesday whether her boyfriend had grabbed the wheel, she replied, "No, he didn't."
Members of Rutledge's family said Ryster has given them various accounts of what caused the crash.
