Cinadr asks for sentence to be shortened

A 29-year-old man has asked for reconsideration of a five-year prison sentence he received for leaving the scene of a fatal accident last October.
Michael James Cinadr of Davenport pleaded guilty Feb. 8 to leaving the scene of an accident resulting in death. He was charged in connection with an accident that killed a pedestrian, Kay Kraske, 45.
Cinadr was sentenced to five years in prison on March 22, and he currently is in Fort Madison State Penitentiary.
The motion to reconsider the sentence was filed Tuesday. No hearing for the motion has been scheduled.
District Judge Bobbi Alpers, who sentenced Cinadr and will rule on the motion, sent a letter to the Iowa Parole Board March 26, raising several factors that should be considered in his release or parole.
The factors were:
-- The offense included Kraske’s death.
-- Cinadr had an extensive history of traffic violations but hadn’t served any jail time.
-- Cinadr had alcohol, substance abuse and mental health issues raised in the presentence report.
-- Cinadr would benefit from programs that could help him achieve personal and economic stability.
-- He showed remorse for the death of the victim.
Kraske was killed shortly after 7 a.m. Oct. 22 in the 1400 block of West River Drive while walking to the Pumpkin Dash on Credit Island. Police said Kraske was walking along the edge of the road when she was struck by the right side of the car.
Police said Kraske was on the wrong side of the road, walking on the north edge. According to the law, in areas where there is no sidewalk, pedestrians should walk toward oncoming traffic. Cinadr apparently didn’t see Kraske. After the accident, Cinadr left only to return to see what happened, and officers remembered seeing him at the scene.
