Federal officials decided late Wednesday to take up the case against David Robert McMenemy, the Michigan man who is accused of crashing his car into a Davenport medical center  Monday because he thought it was an abortion clinic.

The case will be pursued through the U.S. Attorney’s office for the Southern District of Iowa, Davenport, and the Rock Island office of the federal Bureau of Alcohol, Tobacco and Firearms, or ATF.

Police say McMenemy, 45, came to Davenport from the suburbs of Detroit, and drove his compact car into the Edgerton Women’s Health Center, 1510 E. Rusholme St., early Monday morning.

The facility was founded in 1972 to provide prenatal care and medical services to low-income and underprivileged women. It does not perform abortions, nor does it make abortion referrals, Center President Tom Fedje said.

After the car came to rest in the lobby area, Davenport police said McMenemy exited the vehicle and scattered gasoline over the car’s interior before lighting it. He left the building and surrendered to Davenport firefighters, Fire Marshal Mike Hayman said.

Federal charges are appropriate in the case because McMenemy traveled across three states to commit the act of violence, Scott County Attorney Bill Davis said.

Local authorities have leveled a charge of second-degree arson against McMenemy. It’s a Class C felony punishable by a maximum prison term of 10 years and a fine not exceeding $10,000. He is scheduled to be arraigned on that charge Oct. 5 in Scott County District Court, Davenport.
