ALEDO, Ill. — A former Mercer County man deemed to be sexually violent almost six years ago is seeking a conditional release from state custody.
Darin Brock, 35, returned Thursday to Mercer County Circuit Court for an evidentiary hearing to determine whether he is fit to re-enter society under strict conditions.
Brock’s attorney argued his client has made sufficient progress under a sex-offender treatment program. But the state contested that assessment, contending that he remains a threat to the public. Mercer County Judge James Conway has taken the matter under advisement and will render a ruling at a later date.
The former Keithsburg man was found to be sexually violent during a bench trial in May 2000 in Mercer County Circuit Court. Under the Sexually Dangerous Persons Commitment Act, his case is reviewed on an annual basis.
Brock was sentenced to 20 years in prison in 1990 for raping a 65-year-old Joy woman after breaking into her home in 1989. He served 10 years in prison before being declared sexually dangerous and is now in Illinois Department of Human Services custody receiving treatment.
Brock also was charged in a similar incident in 1989 involving an elderly Keithsburg woman. However, those charges were dismissed as part of a plea agreement because the 81-year-old victim never reported the assault to authorities and died a month later in a nursing home.
